1. Agreement to Terms By downloading, installing, or using AI Tourmate ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app. Contact: support@aitourmate.eu

2. Description of Service AI Tourmate is a mobile application that provides automated audio tours based on your GPS location. The app uses:

  • Location data to detect nearby Points of Interest (POI)

  • OpenAI API to generate audio narrations

  • OpenStreetMap data (via Overpass API) for POI information

3. License to Use We grant you a limited, non-exclusive, non-transferable license to use AI Tourmate for personal, non-commercial purposes. You may NOT:

  • Reverse engineer or decompile the app

  • Use the app for commercial tours without permission

  • Redistribute or resell the app

  • Use the app for illegal purposes

4. Location Services AI Tourmate requires GPS location access to function. By using the app, you consent to:

  • Continuous location tracking while the app is active

  • Sending location data to third-party APIs (OpenAI, Overpass API)

  • Geofencing to trigger audio tours automatically

You can disable location access in your device settings, but the app will not work without it.

5. Content Accuracy Disclaimer AI Tourmate generates POI descriptions using AI (OpenAI GPT models) and public data (OpenStreetMap). We strive for accuracy, but:

  • Content may contain errors or be outdated

  • We are not responsible for inaccurate or misleading information

  • Always verify critical information (e.g., opening hours, admission fees) independently

  • Historical facts may not be 100% accurate

Use the app at your own risk.

6. Third-Party Services AI Tourmate relies on third-party services:

We are not responsible for disruptions caused by third-party service outages.

7. User Conduct You agree NOT to:

  • Use the app while driving (unless using hands-free audio)

  • Rely solely on the app for navigation or safety

  • Trespass on private property to visit POI

  • Use the app in restricted or prohibited areas

  • Violate local laws or regulations

Your safety is your responsibility.

8. Fees and Payments

  • AI Tourmate offers first 5 POIs free

  • After that: $9.99/month subscription for 120 POIs monthly

  • Extra POI packages available for purchase (from $2.99)

  • Any changes will be communicated in advance

9. Limitation of Liability To the maximum extent permitted by law:

  • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app

  • This includes: data loss, device damage, accidents, injuries, or financial losses

  • Maximum liability: The amount you paid for the app

10. Indemnification You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the app

  • Violation of these Terms

  • Violation of third-party rights

11. Privacy Your use of AI Tourmate is also governed by our Privacy Policy. Please review it to understand how we collect and use your data.

12. Termination We reserve the right to:

  • Suspend or terminate your access to the app at any time

  • Discontinue the app without notice

You may stop using the app at any time by uninstalling it.

13. Changes to Terms We may update these Terms of Service. Changes will be posted in the app. Continued use means you accept the updated Terms.

14. Governing Law These Terms are governed by the laws of Hungary (or your jurisdiction if applicable). Disputes will be resolved in the courts of Hungary.
